These Terms and Conditions (“Terms”) govern all bookings, purchases, and participation in tours operated by BestTour LLC (“the Company,” “we,” or “us”). By booking a tour, purchasing a gift card, or participating in an activity, you (“the Customer” or “Participant”) agree to these Terms in full.

SECTION 1. RESERVATIONS, PAYMENT, AND CONFIRMATION

  1. Booking Channels: All tours must be booked and paid for in advance through our website or an authorized booking partner (including third-party OTAs such as Viator, GetYourGuide, or Airbnb Experiences).
  2. Payment: Payment may be made by credit card, debit card, PayPal, or other accepted electronic methods specified on our booking page. 
  3. Confirmation: A booking confirmation email will be issued once payment is received. The Customer must review this confirmation immediately and report any errors within twenty-four (24) hours of receipt.

SECTION 2. CANCELLATION, REFUNDS, RESCHEDULING, AND NO-SHOWS

  1. Customer Cancellation:
    • Cancellations made more than 48 hours before the scheduled tour time: Full refund.
    • Cancellations made between 24 and 48 hours before the scheduled tour time: 50% refund.
    • Cancellations made less than 24 hours before the scheduled tour time: No refund.
  2. Rescheduling: Customers are allowed to reschedule their tour up until 48 hours before their original tour time, subject to availability. * BestTour LLC will make every reasonable effort to accommodate your request; if rescheduling isn’t possible within 48 hours, the cancellation policy above applies.
  3. No-Show Policy:Failure to appear at the designated time and location for a tour is considered a no-show. No refund, reschedule, or credit will be provided, regardless of reason (including travel delays or transportation issues).
  4. Company Cancellation:
    Tours proceed rain or shine. However, we reserve the right to cancel or reschedule a tour due to:
  • Severe or unsafe weather (e.g., named storms, lightning, mandatory evacuations); 
  • Public safety concerns, transportation closures, or guide illness; or 
  • Force majeure events (see Section 11).

In such cases, the Customer may choose between a full refund or rescheduled date. Minor modifications (e.g., change in route, venue, or timing) do not entitle Customers to refunds or compensation.

SECTION 3. WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION

This section is a formal contract between you and BestTour LLC, and it significantly limits our liability. Please read it carefully.

  1. Voluntary Participation and Assumption of Risk By booking and participating in any tour operated by BestTour LLC (the “Activity”), you acknowledge that the Activity involves known and unanticipated risks which could result in physical injury, illness, property damage, or even death. These risks include, but are not limited to: walking on uneven terrain, public streets, and stairs; varying weather conditions; exposure to vehicles; and, specific to food tours, the risk of allergic reactions or foodborne illnesses. You understand and freely accept that participation is voluntary and that YOU VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ALL RISKS, INJURIES, OR DAMAGES that may occur during your participation.
  2. Release and Waiver of Liability To the fullest extent permitted by law, you hereby, for yourself, your heirs, personal representatives, and assigns, FOREVER RELEASE AND DISCHARGE BestTour LLC, its registered agents, employees, contractors, affiliates, owners, and insurers (the “Released Parties”) from any and all claims, demands, actions, or causes of action, whether known or unknown, foreseen or unforeseen, arising out of or related to your participation in the Activity, INCLUDING, BUT NOT LIMITED TO, CLAIMS ARISING FROM THE NEGLIGENT ACTS OR OMISSIONS OF THE RELEASED PARTIES.
  3. Indemnification You agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from and against any and all losses, liabilities, claims, demands, costs, or expenses (including reasonable legal fees) asserted by any third party, including any person in your traveling party or immediate family, that arise out of or in connection with: (i) your or your party’s gross negligence or willful misconduct; (ii) any breach of these Terms; or (iii) any injury or damage caused by you or your party while participating in the Activity.

SECTION 4. Food Tour Liability and Waiver (Restaurant Food Protection)

By participating in a food tour, you acknowledge that food is provided by independent, third-party establishments (restaurants, cafes, etc.) and not directly by BestTour LLC.

  1. Disclaimer for Food Quality and Safety: We select our partners with care but cannot supervise their food preparation practices, hygiene, or kitchen environments. We expressly disclaim all liability and responsibility for any injury, illness, allergic reaction, or food poisoning arising from the consumption of food or beverages provided by these independent third-party vendors.
  2. Waiver of Claims: BY PARTICIPATING IN A FOOD TOUR, YOU WAIVE ANY AND ALL CLAIMS against BestTour LLC and its food suppliers arising from any adverse reaction, illness, injury, or loss related to food consumption or quality control. You accept:
  3. Full personal responsibility for your own allergies, intolerances, and/or health issues. b. Full responsibility for the allergies, dietary, and medical needs for all other members of your party.

SECTION 5. Tour Modifications and Conduct

  1. Tour Modifications: We reserve the right to modify or cancel tours where necessary, including changes to the route, itinerary, timing, or assigned guide, with or without prior notification. b. Conduct: Participants are expected to follow the instructions of the tour guide and behave in a respectful and courteous manner. c. Removal from Tour: The Company reserves the right to refuse service to, or remove, any participant who is intoxicated, disorderly, disruptive, or poses a safety risk to themselves or others. Removal under these circumstances will occur without a refund.

SECTION 6. INDEPENDENT CONTRACTORS

All guides, leaders, and affiliates engaged by BestTour LLC act as independent contractors. The Company disclaims liability for their acts, omissions, or regulatory compliance, including licensing or insurance coverage. Claims directly arising from contractor conduct should, where appropriate, be addressed to the contractor.

SECTION 7. Limitation of Liability

To the maximum extent permitted by the law of the governing jurisdiction (Delaware, USA), BestTour LLC’s total liability for any claim, loss, or damage shall be limited to the amount of the total tour price paid by the Customer for the specific tour giving rise to the claim. In no event shall BestTour LLC be liable for indirect, incidental, special, exemplary, punitive, or consequential losses, including but not limited to, loss of enjoyment, lost income, or lost data.

SECTION 8. PHOTOGRAPHY AND MEDIA CONSENT

By participating, you consent to BestTour LLC capturing and using your image or likeness in promotional materials (including online, social media, and advertising).
Customers who do not wish to be photographed must notify the guide prior to the start of the tour.

SECTION 9. Intellectual Property

All content and materials used in our tours, including logos, images, and text, are the property of the operator and may not be reproduced or used without permission.

SECTION 10. GIFT CARDS AND THIRD-PARTY VOUCHERS

  1. Gift Cards:
    Gift cards purchased directly from BestTour LLC are non-refundable, non-transferable, and valid only for tours operated by the Company. They cannot be exchanged for cash except as required by law.
  2. Third-Party Vouchers:
    Vouchers purchased through authorized OTAs are governed by the OTA’s own terms and redemption rules. BestTour LLC is not responsible for lost, expired, or invalid third-party vouchers.

SECTION 11. FORCE MAJEURE

The Company shall not be liable for any failure or delay in performing its obligations when caused by events beyond its reasonable control, including but not limited to natural disasters, acts of war, terrorism, strikes, epidemics, or governmental restrictions.
In such cases, Customers may receive rescheduling or credit; refunds are granted at the Company’s discretion.

SECTION 12. GOVERNING LAW AND DISPUTE RESOLUTION

  1. Governing Law:
    These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules.
  2. International Consumers:
    For Customers residing in the United Kingdom or European Union, mandatory consumer rights under local law remain unaffected to the extent required by law.
  3. Mandatory Arbitration (U.S. Customers):
    All disputes shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in Dover, Delaware, under its Commercial Arbitration Rules. Judgment may be entered in any court with jurisdiction. You waive the right to a jury trial.
  4. Class Action Waiver You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. To the fullest extent permitted by law, (i) no arbitration or proceeding shall be joined with any other; (ii) there is no right or authority for any dispute to be arbitrated or resolved on a class-action basis; and (iii) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
  5. Severability If any part of these Terms is deemed invalid, void, or unenforceable by an arbitrator or court of competent jurisdiction, that provision shall be severed, and the remaining provisions will remain in full force and effect.

SECTION 13. NOTICES

All official communications from BestTour LLC will be sent using the contact details provided at booking.
We may contact Customers by email, phone, or WhatsApp for international calls. Notices are deemed received upon successful transmission.

SECTION 14. ENTIRE AGREEMENT

These Terms, together with any booking confirmation and the Company’s Privacy Policy, constitute the entire agreement between the Customer and BestTour LLC.
No verbal representations or prior communications shall modify these Terms without written consent of the Company.

By booking a tour, you acknowledge that you have read, understood, and agreed to these Terms and Conditions in full.
